Jason L. Fulk

Jason Fulk is a partner with Hoover Hull LLP.  His clients range from Fortune 500 to emerging companies, family-run businesses and individuals. Jason practices primarily in the areas of motorsports law and commercial litigation. He is admitted to practice before all state and federal courts in Indiana, as well as before the U.S. Court of Appeals for the Seventh Circuit.

Jason was selected for inclusion in the listing of Indiana Rising Stars®** for each of the years 2009-2012. He was named a finalist in the Law category for the Indy’s Best and Brightest Awards presented by KPMG LLP in each of 2010 and 2011.

Relevant Experience

  • Represents businesses and individuals in commercial civil disputes, including those involving contract performance and interpretation issues and business torts, including breach of fiduciary duty, fraud, tortious interference and trade secret misappropriation.
  • Represents motorsports teams, owners, drivers and sanctioning bodies in commercial disputes, including those involving driver services agreements, sponsorship agreements, promoter agreements and other agreements utilized in the motorsports industry.
  • Represents professional drivers (including multiple Indianapolis 500 winners) in negotiations with teams and sponsors, including agreements relating to the NASCAR Sprint Cup Series, IZOD IndyCar Series and Firestone Indy Lights Series.

Education and Prior Employment

  • Jason attended the Indiana University Kelley School of Business - Bloomington, obtaining B.S. degrees, with distinction, in both Marketing and Computer Information Systems (1998).
  • Jason was employed as a Management Consultant at PricewaterhouseCoopers LLP (1998-2001), where he advised publicly-traded and start-up entities regarding information technology deployment and business process improvement.
  • Jason earned his J.D. from the Indiana University Maurer School of Law - Bloomington (2004). He served as a Managing Editor of the Indiana Law Journal and received the Best Brief Award in 2002-03 Sherman Minton Moot Court Competition. He also served as a summer law clerk for the Honorable Magistrate Judge Tim A. Baker of the U.S. District Court for the Southern District of Indiana (2002).

  • Jason is a member of the American, Seventh Circuit, Indiana State (ISBA) and Indianapolis Bar Associations. He serves on the ISBA's Federal Judiciary and American Citizenship Committees.
  • Jason is a member of the Defense Trial Counsel of Indiana (DTCI) and the Defense Research Institute (DRI), and is a Barrister of the Sagamore American Inn of Court (2010-15).
  • Jason is a member of the Indiana Motorsports Association and the Sports Lawyers Association.
  • Jason volunteered for the Indiana Sports Corporation, where he served as a Vice Chair for the Local Organizing Committee (LOC) for the U.S. Olympic Team Trials for Diving (2008). He also served on LOCs for the AT&T USA Outdoor Track and Field Championships (2006, 2007).

  • JPMorgan Chase Bank, N.A. v. Desert Palace, Inc., 882 N.E.2d 743 (Ind. Ct. App. 2008) (commercial litigation; on issue of first impression, holding that trial court's exercise of personal jurisdiction over non-resident defendant casinos would not violate their constitutional due process rights).
  • Indiana Lumbermens Mut. Ins. Co. v. Reinsurance Results, Inc., 513 F.3d 652 (7th Cir. 2008) (commercial litigation; affirming summary judgment in favor of insurer; rejecting service provider's claim for compensation for work performed outside the scope of a service contract).
  • Overton v. Foutty & Foutty, LLP, No. 1:07CV0274, 2007 WL 2413026 (S.D. Ind. August 21, 2007) (professional liability; granting defendant law firm's motion to dismiss plaintiffs' claim for compensation for emotional distress resulting from alleged negligence and FDCPA violations).
  • Henderson v. Biel, No. 1:05-CV-1485, 2007 WL 2286129 (S.D. Ind. August 7, 2007) (professional liability; granting summary judgment in favor of a debt collector based on FDCPA's bona fide error defense).
